Privacy Policy
Last Updated: August 18, 2026
This Privacy Policy describes the policies of Kenmore Development P.O. Box 194, Kenmore NY 14217, United States of America (“Kenmore Development”), email: answers@kendev.com, phone: (716) 874-7700 on the collection, use and disclosure of your information that we collect when you use our website (https://www.kendev.com) (the “Service”). This Policy explains what we do with your information. Where the law requires your consent before we do something, we ask you for it separately and you can withdraw it: browsing the Service is not by itself treated as consent to anything beyond what is strictly necessary to deliver it.
We may modify this Privacy Policy at any time and will post the revised Privacy Policy on the Service, updating the “Last Updated” date shown above. Any changes will be effective immediately upon posting, and your continued access or use of the Service after that will constitute your acceptance of the revised Privacy Policy. We therefore recommend that you periodically review this page. Our Cookie Policy, which forms part of this Policy, is updated on the same basis.
Information We Collect:
We may collect and process the following personal information about you only when you voluntarily provide it to us, for the purposes of processing rental applications, processing payments, analyzing our marketing efforts and providing efficient service to anyone that has contacted us:
- Name
- Phone
- Current and Prior Home or Work Address(es)
- Government ID Details (When Applying for Apartment)
- Financial Information: We may collect financial information, including but not limited to credit reports, bank account details, payment history, and employment details to evaluate rental applications, process payments, and ensure timely rent collection.
- Employment and Income Information: We may collect details regarding your current and past employment, income, or employment history to assess your ability to fulfill financial obligations under the lease agreement.
- Emergency Contact Information: We may collect emergency contact information to be used in case of urgent situations, such as property emergencies or health-related issues.
This information is collected when you directly interact with us, such as by calling our customer service line (which may include caller ID information), sending us a text message, or by submitting forms on our website. We do not ask you for personal information of this kind without telling you why we need it, and we do not require any of it simply to browse the Service. The next section covers the limited information that a visit creates automatically.
Information Collected Automatically When You Visit This Website:
The section above describes information you give us on purpose. Visiting kendev.com also creates a small amount of information automatically, and we would rather set it out plainly than leave it implied:
- Anonymous traffic measurement. We use Fathom Analytics to count visits and see which pages are read. Fathom sets no cookies, assigns you no identifier, and does not track you across other websites. It cannot single you out, and we cannot use it to identify you. It runs on every visit.
- A record of your cookie choices. When you make a choice about embedded content, we store that choice together with the date, the page you were on, your browser’s user-agent string, the version of our policy in force, and a random identifier generated in your browser. We keep this as proof of what you were asked and what you answered. It deliberately does not include your IP address, and it is deleted automatically after 36 months.
- Ordinary server and security logs. Like any website, our hosting and security providers record requests made to the site.
We do not use this information to build a profile of you, and we do not sell or share it for advertising.
Data Accuracy:
We rely on the accuracy of the information you provide. Please notify us immediately of any changes to your personal information so we can keep our records up to date.
How We Use Your Information:
We will use the information that we collect about you for the following purposes:
- Lease management and renewal: To manage the terms of your lease, including renewals, extensions, or modifications to your rental agreement.
- Coordinating maintenance requests: To schedule and track necessary repairs and maintenance for your apartment.
- Processing payments: To handle rent payments, deposits, and other financial transactions related to your tenancy.
- Customer feedback collection: To gather your thoughts and suggestions to improve our services and tenant experience.
- Tenant support: To address your inquiries, requests, or concerns related to your lease or living conditions.
- Administrative purposes: For general record-keeping, lease management, and compliance with legal obligations.
- Security and safety: To ensure the safety and security of the property and residents, including monitoring access, conducting background checks, and responding to emergency situations.
- Compliance with laws and regulations: To comply with local, state, or federal laws, including tenant rights, fair housing regulations, and tax reporting.
- Third-party services: To share information with trusted third-party vendors or partners (e.g., property management software providers, utility companies, contractors) necessary for property management and service delivery.
- Insurance purposes: To provide or manage renters’ insurance, or in the event of property damage claims.
- Legal proceedings: In case of disputes, evictions, or other legal matters, your information may be used to support the resolution of such issues.
- Marketing: to tell you about available apartments and our services, using the contact details you have given us directly. Any advertising we buy is targeted using information you provided to us or by the ad platform’s own audience tools. We do not use information about your visit to this website for advertising, we place no advertising cookies or pixels on the Site, and we do not sell your information.
If we want to use your information for any other purpose, we will ask you for consent and will use your information only on receiving your consent and then, only for the purpose(s) for which grant consent unless we are required to do otherwise by law.
How We Share Your Information:
We will not transfer your personal information to any third party without seeking your consent, except in limited circumstances as described below:
- Payment processing tools
- Essential communication tools
- Advertising platforms and marketing agencies, using contact details you gave us directly. Information about your visit to this website is not shared with them.
- Analytics tools. Ours is Fathom Analytics, which is anonymous and receives no information that identifies you.
- Customer and property relationship management software
We require such third parties to use the personal information we transfer to them only for the purpose for which it was transferred and not to retain it for longer than is required for fulfilling the said purpose.
To be specific about the website: we do not share information about your visit to kendev.com with advertising services or advertising networks, and we do not sell it. Our website analytics are anonymous and cannot be tied back to you.
We may share your information with trusted service providers, such as maintenance teams, utility providers, or property management platforms, for the purpose of managing your rental experience.
We may also disclose your personal information for the following: (1) to comply with applicable law, regulation, court order or other legal process; (2) to enforce your agreements with us, including this Privacy Policy; or (3) to respond to claims that your use of the Service violates any third-party rights. If the Service or our company is merged or acquired with another company, your information will be one of the assets that is transferred to the new owner.
Retention Of Your Information:
We will retain your personal information with us for as long as we need it to fulfill the purposes for which it was collected as detailed in this Privacy Policy. We may need to retain certain information for longer periods such as record-keeping / reporting in accordance with applicable law or for other legitimate reasons like enforcement of legal rights, fraud prevention, etc. We may also retain your data to comply with legal obligations such as tax reporting, anti-money laundering laws, or other regulatory requirements. Residual anonymous information and aggregate information, neither of which identifies you (directly or indirectly), may be stored indefinitely. The record of your cookie choices described above is deleted automatically after 36 months.
Your Rights:
Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. To exercise these rights, you can write to us at answers@kendev.com. We will respond to your request in accordance with applicable law.
Do note that if you do not allow us to collect or process the required personal information or withdraw the consent to process the same for the required purposes, you may not be able to access or use the services for which your information was sought.
Cookies And Embedded Content:
Our Cookie Policy sets out the full detail. In summary:
- We use no advertising or marketing cookies, no advertising pixels, and no Google Analytics, Google Tag Manager or Google Ads.
- Two third-party services load automatically because the site cannot function without them: Google Maps, which loads only on pages that display a map, and Cloudflare Turnstile, which protects our forms from automated abuse.
- Some pages contain content hosted by other companies — resident reviews from Birdeye, 3D tours from Matterport, videos from YouTube, and posts from Instagram. Those companies can set their own cookies, so we do not load any of it until you ask. You will see a notice naming the company and a button to load it; nothing is requested from them before you press it. YouTube videos load in YouTube’s privacy-enhanced mode.
- If your browser sends a Global Privacy Control signal and you have not made a choice yourself, we treat it as a decision to load no embedded content.
- You can change or withdraw your choices at any time using the Cookie Preferences link in the footer of every page.
Security:
The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorized alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.
Third Party Links & Use Of Your Information:
Our Service may contain links to other websites that are not operated by us. This Privacy Policy does not address the privacy policy and other practices of any third parties, including any third party operating any website or service that may be accessible via a link on the Service. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
The same applies to the embedded content described above. If you choose to load a video, 3D tour, review widget or social post, that content is delivered by the company that hosts it, under that company’s own privacy policy, and it may set its own cookies. That is why we ask first rather than loading it for you.
Grievance / Data Protection Officer:
If you have any queries or concerns about how we handle your information, contact our Grievance Officer by email at answers@kendev.com, by phone at (716) 874-7700, or by post at Kenmore Development, P.O. Box 194, Kenmore NY 14217. We will address your concerns in accordance with applicable law.
